Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of Delusia.AI, including our website, mobile app, and AI phone receptionist service (collectively, the “Service”). By accessing or using Delusia.AI, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Service.

2. Service Description

Delusia.AI provides an AI-powered phone receptionist service that answers incoming calls on behalf of users. The Service includes: 24/7 call answering and routing, real-time call transcription and recording, appointment scheduling and calendar integration, automated follow-up and callback functionality, call analytics and reporting, and customer dashboard access.

3. Eligibility

By using Delusia.AI, you represent and warrant that: you are at least 18 years old or the legal age of majority in your jurisdiction, you have the legal authority to enter into these Terms, you will use Delusia.AI only for lawful purposes and in compliance with all applicable laws and regulations, and you own or have authority over the phone number being used with Delusia.AI.

4. Account Registration

To use Delusia.AI, you must create an account and provide accurate, complete, and current information. You are responsible for: maintaining the confidentiality of your account credentials, all activities that occur under your account, notifying us immediately of any unauthorized use of your account, and keeping your account information up to date.

Delusia.AI reserves the right to suspend or terminate accounts that provide false or misleading information.

5. Subscription & Billing

Free Trial: New users receive a free trial period as specified at signup. The free trial includes a limited amount of AI call minutes.

Paid Plans: After the free trial or if you choose a paid plan, you authorize Delusia.AI to charge your payment method monthly. Billing will occur on the same day each month. If your payment fails, we may suspend your Service until payment is received.

Cancellation: You may cancel your subscription at any time through your account Billing settings. Cancellation takes effect at the end of your current paid billing period — you retain full access through that date. Subscriptions cancelled during a free trial period incur no charge.

14-day money-back guarantee: If you are charged for your first month of paid service and decide Delusia.AI isn't the right fit, contact support@delusia.ai within 14 days of the first charge and we will refund that month in full. Refunds are processed via Stripe within 5–10 business days back to the original payment method.

Refunds after the first month: Beyond the initial 14-day window, we do not provide prorated refunds for partial months. If your subscription auto-renewed and you missed cancelling, please contact support — we evaluate one-off refund requests on a case-by-case basis and are generally accommodating when the renewal is recent and the service was unused.

Failed payments: If your payment method declines, we will retry the charge automatically over a 7-day grace period. After that, the Service is suspended until payment is restored. Suspended accounts retain all data for 30 days; after 30 days of non-payment the account may be deleted.

6. Acceptable Use Policy

You agree to use Delusia.AI only for lawful business purposes. The following are strictly prohibited and will result in immediate account termination without refund:

• Illegal activity — fraud, scams, money laundering, drug trafficking, human trafficking, content prohibited by applicable law.
• Unsolicited marketing — placing or facilitating robocalls, spam SMS, or marketing calls without proper consent under TCPA (US), CASL (Canada), or equivalent local laws. This includes use of Delusia's outbound calling features for cold sales without prior express written consent.
• Harassment — threatening, abusive, defamatory, or harassing communications via voice or SMS.
• Impersonation — pretending to be another person, business, or government entity. Using Delusia.AI to clone someone else's voice without their explicit consent.
• Phishing / fraud — calls or texts designed to deceive recipients into providing credentials, payment information, or other sensitive data.
• Bypassing carrier rules — knowingly violating Twilio's Acceptable Use Policy, A2P 10DLC restrictions, Do-Not-Call registries, or carrier-imposed throttling.
• Reverse engineering — attempting to derive our source code, scraping the application, or reselling the Service without explicit permission.
• Excessive load — automated traffic that materially impacts other customers' service quality.
• Sensitive industries without compliance review — healthcare (HIPAA), payment card data (PCI), or financial advisory require explicit pre-approval. Contact us before using Delusia.AI for these use cases.

You agree to indemnify Delusia.AI against any third-party claims arising from your violation of this Acceptable Use Policy.

7. Call Recording & Data

Recording Disclosure: When call recording is enabled, Delusia.AI's AI automatically informs callers that the call may be recorded. This disclosure is provided to comply with applicable state and federal laws.

Data Ownership: You retain ownership of all call data, recordings, and caller information generated through the Service. Delusia.AI uses this data only to provide and improve the Service.

Call Retention: Call recordings and transcripts are retained according to your plan and applicable legal requirements. You may delete recordings through your dashboard at any time.

8. TCPA Compliance

You agree to comply with the Telephone Consumer Protection Act (TCPA) and all applicable telemarketing and auto-dialer laws. This includes: maintaining and honoring Do Not Call (DNC) registry lists, obtaining prior written consent before placing telemarketing or robocalls, including your business name and callback number in outgoing messages, respecting quiet hours (no calls before 8 AM or after 9 PM in the recipient's time zone), and providing an easy opt-out mechanism for all follow-up calls and texts.

Delusia.AI provides tools to support compliance, but you are solely responsible for ensuring your use complies with all applicable laws. Misuse of the Service for illegal telemarketing or auto-dialing will result in immediate account termination.

9. CASL Compliance (Canadian Customers)

Canada's Anti-Spam Law (CASL) governs commercial electronic messages (CEMs) including SMS sent to Canadian recipients. By using Delusia.AI you confirm that:

• You have express or implied consent (e.g., a prior business relationship) for every recipient you send SMS to from your Delusia number.
• Every SMS your business sends through Delusia includes a clear identification of the sender and a working unsubscribe mechanism (we add a STOP keyword automatically; you must not strip it).
• You honor unsubscribe requests within 10 business days as required by CASL.
• You retain records of consent for at least 3 years.

Delusia.AI's inbound-call-initiated SMS flow (where a caller dials your business and receives an automatic follow-up SMS) is generally treated as implied consent under CASL's “existing business relationship” exemption. Any other use cases (outbound campaigns, bulk SMS) require explicit consent that you must obtain and document.

10. Intellectual Property

Delusia.AI and its content, including software, designs, trademarks, and text, are owned by or licensed to Delusia.AI. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal or business use. You may not: copy, modify, or create derivative works; reverse engineer, decompile, or attempt to derive source code; remove or alter any proprietary notices; or resell or redistribute the Service.

11. Limitation of Liability

Disclaimer: THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. MISSEDCALL.AI MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISSEDCALL.AI'S LIABILITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

Delusia.AI is not responsible for: missed calls due to network, service, or technical failures; loss of call recordings or data due to hardware failure or force majeure; calls not meeting your expectations or requirements; or compliance failures resulting from your use of the Service.

12. Termination

Termination by You: You may terminate your account at any time by contacting support or through your account settings. Termination takes effect immediately.

Termination by Delusia.AI: We may terminate or suspend your account immediately if: you violate these Terms or applicable laws, you use the Service for spam, harassment, or illegal purposes, payment fails and remains unpaid for 30 days, or we believe your use poses a risk to us or other users.

Upon termination, your access to the Service ceases immediately. You may request deletion of your data as permitted by law.

13. Changes to Terms

Delusia.AI may update these Terms at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes indicates your acceptance of the new Terms. If you do not agree with changes, you must discontinue use and terminate your account.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Delusia.AI operates, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of courts in that jurisdiction.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will continue in effect.
